1. Acceptance of Terms
Welcome to Elevate (the "Platform" or "Service"), operated by Elevate Pyro ("Elevate," "we," "our," or "us"). These Terms of Service ("Terms," "Agreement") govern your access to and use of the Elevate platform, including all features, content, and services provided.
By creating an account, accessing, or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Platform.
2. Eligibility and Account Creation
2.1 Age Requirement
You must be at least 18 years old to create an account and use Elevate. By creating an account, you represent and warrant that you are 18 years of age or older.
Rationale: Due to the nature of pyrotechnics (explosives, fireworks, regulated materials), federal and state laws restrict access to information and materials related to explosives to individuals 18 and older.
2.2 Account Registration
To create an account, you must:
Provide accurate, complete, and current information
Choose a unique username and secure password
Provide a valid email address
Agree to these Terms of Service and our Privacy Policy
2.3 Account Security
You are responsible for maintaining the confidentiality of your password
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account
We strongly recommend enabling two-factor authentication (2FA)
3. User Responsibilities
3.1 Accurate Information
You agree to:
Provide truthful and accurate information in your profile and resume
Not misrepresent your credentials, certifications, or experience
Update your information promptly when it changes
Not impersonate another person or entity
3.2 Safety and Compliance
As a pyrotechnics platform, safety is paramount. You agree to:
Follow all applicable federal, state, and local laws regarding explosives and fireworks
Maintain valid licenses and permits for all pyrotechnics activities
Not share information that could enable unsafe or illegal pyrotechnic practices
Report unsafe practices or illegal activity you observe on the Platform
3.3 Respectful Conduct
Treat all community members with respect and professionalism
Not harass, bully, threaten, or intimidate other users

4. Prohibited Activities
The following activities are strictly prohibited on Elevate:
4.1 Illegal Content and Activities
Promoting, selling, or sharing information about illegal fireworks or explosives
Providing instructions for improvised explosive devices (IEDs)
Encouraging pyrotechnics activities without proper licenses
Illegal transactions or sales
4.2 Unsafe Practices
Promoting unsafe pyrotechnics practices or "stunts"
Sharing formulas for dangerous homemade devices
Encouraging violation of ATF, CPSC, or industry safety standards
4.3 Misrepresentation and Fraud
Claiming certifications, licenses, or experience you don't have
Impersonating another person or entity
Posting false reviews or testimonials
4.4 Harassment and Abuse
Bullying, threatening, or intimidating other users
Hate speech or content promoting violence
Sexual harassment or explicit content
Publishing private information about others (doxxing)
5. Content Ownership and Licensing
5.1 Your Content Ownership
You retain full ownership of all content you create and post on Elevate, including text, photos, videos, resumes, show documentation, and other materials ("User Content").
5.2 License Grant to Elevate
By posting content on Elevate, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:
Display and distribute your content on the Platform
Store and back up your content on our servers
Format and adapt content for different devices and displays
Use content in promotional materials (with attribution)
5.3 License Scope and Duration
This license continues until you delete your content or account. However, content shared with or copied by other users may persist according to their own usage. We do not claim ownership of your content and will not use it outside the Platform without your consent.
5.4 Your Responsibility for Content
You represent that you own or have the right to post all content you share
You are responsible for ensuring your content does not infringe on others' rights
You agree not to post content obtained illegally or without permission
6. Intellectual Property Rights
6.1 Elevate's Intellectual Property
The Elevate name, logo, branding, and all platform code, design, graphics, and features are owned by Elevate and protected by intellectual property laws. You may not use our trademarks, logos, or branding without our prior written consent.
6.2 Platform Code and Design
The Platform's software, code, and architecture are proprietary
You may not copy, modify, or reverse engineer any part of the Platform
Automated scraping or data extraction is prohibited
6.3 DMCA Copyright Policy
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed on Elevate, you may submit a DMCA takedown notice to our designated agent:

6.4 Copyright Infringement Reporting
To report copyright infringement, send a notice to help@elevatepyro.com with the subject line "DMCA Takedown Notice", including:
Identification of the copyrighted work claimed to be infringed
Identification of the infringing material and its location on the Platform
Your contact information (name, address, email, phone)
A statement of good faith belief that the use is not authorized
A statement that the information is accurate and you are authorized to act
Your physical or electronic signature
7. Industry-Specific Safety Disclaimers
7.1 No Safety Guarantee
Elevate does NOT guarantee the safety, accuracy, or completeness of any information shared on the Platform. Information shared by users is for educational and discussion purposes only.
7.2 Professional Advice Required
Always consult qualified professionals and certified instructors
Do not rely solely on information from online forums
Follow manufacturer instructions and safety data sheets (SDS)
Comply with all applicable regulations
7.3 Licensing and Permits
You are solely responsible for obtaining and maintaining all required licenses, permits, and certifications for your pyrotechnics activities, including ATF Federal Explosives License (FEL), state pyrotechnics licenses, local permits, insurance coverage, and safety certifications (PGI, APA, etc.).
7.4 Assumption of Risk
By using information from Elevate, you acknowledge and assume all risks associated with pyrotechnics activities. Fireworks and explosives can cause serious injury or death, property damage and fires, legal consequences, and environmental harm.
8. Professional Use and Transactions
8.1 PyroResume and Job Opportunities
Elevate provides PyroResume features to help pyrotechnics professionals showcase their qualifications and connect with potential employers. These features are provided as a service to the community.
You control the visibility and content of your PyroResume
Employers may search and view public resumes
You are responsible for the accuracy of your resume information
8.2 No Endorsement
Elevate does not endorse, verify, or guarantee any employers, employees, or business opportunities. We do not conduct background checks on users or verify employment claims.
8.3 User Responsibility for Transactions
Conduct your own due diligence before entering into employment relationships
Verify credentials, references, and qualifications independently
Negotiate and execute employment agreements directly with other parties
8.4 Elevate Is Not a Party
Elevate is not a party to any employment agreements, contracts, or transactions between users. We are not responsible for disputes, non-payment, work quality, or any other issues arising from user interactions.
9. Moderation and Enforcement
9.1 Community Guidelines Enforcement
Elevate maintains community guidelines to ensure a safe, professional, and welcoming environment. Our moderation team enforces these guidelines consistently and fairly.
9.2 Content Removal
We reserve the right to remove any content that violates our Terms of Service, Community Guidelines, or applicable laws. Content may be removed with or without notice depending on the severity of the violation.
9.3 Enforcement Actions
Depending on the nature and severity of violations, we may take the following actions:
Warning: Formal notification of the violation
Content removal: Deletion of offending content
Temporary suspension: Time-limited account restriction
Permanent ban: Permanent account termination
Legal referral: Reporting to law enforcement when required
9.4 Appeals Process
If you believe a moderation action was taken in error, you may appeal through the in-app appeals process (My Appeals) or by contacting help@elevatepyro.com. Appeals are reviewed by senior moderators, and decisions are typically communicated within 7 business days.
9.5 Moderator Discretion
Our moderators exercise discretion in enforcing these Terms. Not all situations can be anticipated, and moderators may take action on content or behavior that undermines the community, even if not explicitly listed in these Terms.
10. Account Termination
10.1 User-Initiated Termination
You may request deletion of your account at any time by contacting help@elevatepyro.com. Upon deletion request:
Deletion is permanent; once your request is processed, your account cannot be recovered
Your sign-in credentials and profile information are removed
Content you contributed may remain on the Platform, disassociated from your deleted profile; residual copies age out of backups within 30 days
10.2 Elevate-Initiated Termination
We may suspend or terminate your account for any of the following reasons:
Violation of these Terms of Service
Violation of Community Guidelines
Illegal activities or safety violations
Credential fraud or misrepresentation
Extended account inactivity (2+ years)
10.3 Effects of Termination
Access to your account and content is revoked
Your profile and resume are removed from public view
Posts and comments you contributed may remain on the Platform, disassociated from your profile
For voluntary deletion, request a copy of your data (see our Privacy Policy) before your deletion request is processed; deletion is permanent once completed
10.4 Survival of Terms
Sections relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination of your account.
11. Disclaimers and Warranties
11.1 Platform Provided "As Is"
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 No Warranty of Accuracy
We do not warrant the accuracy, completeness, or reliability of any content on the Platform, including user-generated content, profiles, resumes, certifications, or technical information.
11.3 No Warranty of Availability
The Platform may experience downtime for maintenance or technical issues
Features may be modified, suspended, or discontinued without notice
We do not guarantee uninterrupted or error-free operation
11.4 User-Generated Content
We are not responsible for user-generated content and do not endorse any opinions, recommendations, or advice shared by users. Users are solely responsible for their own content and interactions.
11.5 Third-Party Links and Services
The Platform may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party sites.
12. Limitation of Liability
12.1 Exclusion of Certain Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, business opportunities, or savings
Loss of data, content, or information
Personal injury, death, or property damage resulting from pyrotechnics activities
Disputes, injuries, or damages arising from interactions with other users
12.2 Maximum Liability Cap
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED $100 USD.
12.3 Industry-Specific Liability
Elevate is NOT liable for: Pyrotechnics accidents, injuries, or fatalities; property damage caused by fireworks or explosives; illegal activities conducted by users; safety violations or regulatory non-compliance; failure to obtain proper licenses; credential fraud or misrepresentation; employment disputes.
13. Indemnification
13.1 Your Agreement to Indemnify
You agree to indemnify, defend, and hold harmless Elevate, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
Your use of the Platform
Your violation of these Terms of Service
Your violation of any applicable laws or regulations
Your content or information you submit to the Platform
Your pyrotechnics activities, whether or not related to information obtained on the Platform
Your interactions with other users
13.2 Scope of Indemnification
This indemnification obligation applies regardless of the form of action or theory of recovery and will survive termination of your account and these Terms.
13.3 Defense and Settlement
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims. You may not settle any claim without our prior written consent.
14. Dispute Resolution
14.1 Informal Resolution First
Before initiating any formal dispute resolution, you agree to contact us at help@elevatepyro.com and attempt to resolve the dispute informally for at least 30 days. Most disputes can be resolved through direct communication.
14.2 Binding Arbitration
If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Arbitration will be conducted in English
The arbitrator's decision shall be final and binding
Judgment on the award may be entered in any court of competent jurisdiction
14.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14.4 Small Claims Exception
Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
14.5 Governing Law and Venue
These Terms and any dispute arising hereunder shall be governed by the laws of the State of New York, without regard to conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in New York.
15. Changes to Terms
15.1 Right to Modify
We reserve the right to modify these Terms of Service at any time. Changes may be made to reflect updates to our practices, new features, legal requirements, or other factors.
15.2 Notification of Changes
Material changes: Email notification to your registered email address
Minor updates: Notice posted on the Platform
Updated "Last Updated" date at the top of this document
15.3 Effective Date
Changes become effective upon posting unless otherwise specified. For material changes affecting your rights or obligations, we will provide at least 30 days' notice before the changes take effect.
15.4 Acceptance of Changes
Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Platform and may request account deletion.
